By accessing or using mapsmith.app and the Mapsmith WordPress plugin ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Description of Service

Mapsmith is a commercial WordPress plugin that enables users to create multi-location maps with custom markers, popovers, and an interactive editor. The Service includes the mapsmith.app website, the license management system, and the downloadable WordPress plugin.

Accounts

You must create an account to purchase a license. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must provide a valid email address. We reserve the right to suspend or terminate accounts that violate these terms.

Licenses

When you purchase a Mapsmith license, you receive a non-exclusive, non-transferable right to use the plugin on the number of WordPress sites permitted by your plan. License keys are personal to your account and may not be shared, resold, or redistributed.

• Pro — use on up to 2 WordPress sites.
• Agency — use on unlimited WordPress sites.

Licenses are perpetual for the version purchased. Access to future updates requires an active license in good standing.

Prohibited Uses

You may not:

• Reverse-engineer, decompile, or create derivative works from the plugin.
• Redistribute, sublicense, or resell the plugin or license keys.
• Use the Service to violate any applicable law or regulation.
• Attempt to circumvent the license activation system.
• Use automated tools to create accounts, generate license keys, or abuse the API.

Payment

All payments are processed by Stripe. Prices are listed in US dollars. By completing a purchase, you authorize us to charge the payment method provided through Stripe. You are responsible for any applicable taxes.

Intellectual Property

The Mapsmith plugin, website, documentation, and all associated branding are the intellectual property of Mapsmith. Your license grants you the right to use the plugin, not ownership of the underlying code or assets.

Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the plugin will be error-free, uninterrupted, or compatible with every WordPress configuration, theme, or hosting environment.

Limitation of Liability

To the maximum extent permitted by law, Mapsmith shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for your license in the 12 months preceding the claim.

Changes to These Terms

We may update these Terms of Service at any time. Material changes will be communicated via the email address on your account. Continued use of the Service after changes constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which Mapsmith operates.
